Welcome to Privacy Policy

This policy sets out how, Sarl handles your personal information. When we say ‘we’, ‘us’ or ‘Datafair’ it’s because that’s who we are and we own and run the Website and Services. If we say ‘policy’ we’re talking about this privacy policy. If we say ‘user terms’ we’re talking about the rules for using the website and services. In this policy, the Website and Services are collectively referred to as the “Services”. Our Services are currently available for use via a web browser or applications specific to your desktop or mobile device. Take the time to read this policy because it forms a part of the user terms for our Services. By using any of our Services, you agree to this policy. If you do not agree to this policy we won’t take it personally, but please do not use our Services.

User Data

Content and information submitted by users, either data sellers or data buyers, to the Services is referred to in this policy as “User Data.” Where Datafair collects or processes User Data, it does so on behalf of our users.

Account creation information: Users may provide information such as an email address, phone number, and password to create an account.

Seller store information: When a user creates a store using the Services, we may collect an email address, a store name, banner photo, domain details (such as, user name for the individual setting up the store, and password. We may also collect details (data set descriptions, images, etc) pertaining to the data sets offered for sale. For more information on seller set-up, click here.

Payment and other information: When users that make purchases using the Services, our corporate affiliates and our third party payment processors may collect and store billing address and credit card information on our behalf or we may do this ourselves.

Personal information we collect about you from others: Although we generally collect personal information directly from you, we may on occasion also collect information about you from other people (such as the payment provider account details required to process a transaction) and by using tracking technologies such as cookies and other web analytics software or services.

Services usage information: This is information about how you are accessing and using the Services, which may include administrative and support communications with us and information about the people, features, content, and links you interact with.

Log data: When you use the Services our servers automatically record information, including information that your browser sends whenever you visit a website or your mobile app sends when you are using it. This log data may include your Internet Protocol address, the address of the web page you visited before using the Services, your browser type and settings, the date and time of your use of the Services, information about your browser configuration and plug-ins, language preferences, and cookie data.

Device information: We may collect information about the device you are using the Services on, including what type of device it is, what operating system you are using, device settings, application IDs, unique device identifiers, and crash data. Whether we collect some or all of this information often depends on what type of device you are using and its settings.

Geo-location information: Precise GPS location from mobile devices is collected only with your permission. WiFi and IP addresses received from your browser or device may be used to determine approximate location.

Services integrations: If, when using the Services, there may be third party services, that connect to ours. The third party integrated services provider may share certain information about your account with Datafair. However, we do not receive or store your passwords for any of these third party services.

Third party data: Datafair may also receive information from our partners, or others that we use to make our own information better or more useful. This might be aggregate level information, such as which IP addresses go with which zip codes, or it might be more specific information, such as about how well an online marketing or email campaign performed

Your Choices

If you choose not to provide User Data, we may not be able to provide you with our Services and you may not be able to carry out transactions or access the full range of features available through our Services.

In addition, you also have choices about cookies. Your browser may provide you with the ability to control cookies or other types of local data storage. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject cookies some parts of our Services may not work properly in your case. Datafair does not control these choices, or default settings, which are offered by makers of your browser or mobile device operating system.

Storing and accessing your User Data

We store User Data on secure servers that are managed by us and our service providers. User Data that we store is subject to security and access controls, including username and password authentication and data encryption where appropriate. We use a global network of service providers in order to ensure that we maintain the best possible service standards. Some of the service providers to whom we may disclose your User Data, like service providers who provide us with cloud storage solutions, are based outside Switzerland. In order to protect your information, we take care where possible to work with service providers who we believe maintain an acceptable high standard of data security compliance.

You can access some of the information that we collect about you by logging in to your account. You also have the right to make a request to access other information we hold about you and to request corrections of any errors in that information. Information about children

Our Services are not suitable for children under the age of 13 years, so if you are under 13 we ask that you do not use our Services or give us your personal information (if you are a young data scientist, please direct your nearest responsible adult to use the Services for you!). If you are from 13 to 18 years, you can browse but will need the supervision of a parent or guardian to become a registered user. It is the responsibility of parents or guardians to monitor their children’s use of our Services.

Sharing and Disclosure

There are times when information described in this privacy policy may be shared by Datafair. This section discusses only how Datafair may share such information. Datafair may share User Data in accordance with our agreement with the user and the user’s instructions, including:

  • With third party service providers and agents: We may engage third party companies or individuals to process User Data.
  • With affiliates: We may engage our affiliates to process User Data.
  • With third party provider: Datafair may, acting on our user’s behalf, share some specific User Data (user name, email address) of a buyer with the seller of an item. Datafair is not responsible for how a seller uses the User Data.

Datafair may share other information as follows:

  • About you with the item seller: There may be times when you contact Datafair to help resolve an issue specific to an offer. In order to help resolve the issue and given our relationship with our sellers, we may share your concern with the other user.
  • With third party service providers and agents: We may engage third party companies or individuals, such as third party payment processors, to process information on our behalf.
  • With affiliates: We may engage affiliates to process other information.

Other types of disclosure

Datafair may share or disclose User Data and other information as follows:

  • During changes to our business structure: If we engage in a merger, acquisition, bankruptcy, dissolution, reorganization, sale of some or all of Datafair's assets, financing, acquisition of all or a portion of our business, a similar transaction or proceeding, or steps in contemplation of such activities (e.g. due diligence).
  • To comply with laws: To comply with legal or regulatory requirements and to respond to lawful requests, court orders and legal process.
  • To enforce our rights, prevent fraud and for safety: To protect and defend the rights, property, or safety of us or third parties, including enforcing contracts or policies, or in connection with investigating and preventing fraud.

We may disclose or use aggregate or de-identified information for any purpose. For example, we may share aggregated or de-identified information with our partners or others for business or research purposes like telling a prospective Datafair user the categories of items that are the most requested or partnering with research firm or academics to explore interesting questions about data science.

Information you make public or give to others: If you make your User Data available to other people, we can’t control or accept responsibility for the way they will use or manage that information. There are lots of ways that you may find yourself providing information to other people, like when you post a public message on a forum thread, share information via social media, or make contact with another user via our Services. Before making your information publicly available or giving your information to anyone else, think carefully. If giving information to another user via our Services, ask them how they will handle your information. If you’re sharing information via another website, check the privacy policy for that site to understand its information management practices as this privacy policy will not apply.
